The Authority's fundamental mission is to ensure that the rights of the insured and beneficiaries of contracts are guaranteed.

ACAPS works towards helping insurance companies and intermediaries to put in place the procedures and means necessary to respond effectively, continuously and efficiently to two main requirements:  

  • Informing citizens about the characteristics of the available coverage offers in order to enable them to make informed decisions about insurance contracts and the practical arrangements for executing these contracts.

  • Fair treatment of insured individuals, in particular with regard to handling their requests and claims, the proper execution of obligations and commitments under insurance contracts and the design and marketing of insurance products that fit the needs of different consumer groups.

 

For this purpose, the Authority ensures the adequacy of the arrangements implemented by insurers and insurance intermediaries to comply with these requirements. It also controls the compliance of marketed insurance products with the regulations in force and ensures compliance with the rights of insured individuals and beneficiaries of insurance contracts as provided for in the regulations and contractual clauses. It also ensures, through regular monitoring and control, that insurance sector players respect good practices for the conduct of their business.

International standards for supervision of the insurance sector place a high value on supervising market practices. The main objective of this control is to maintain a balanced and transparent relationship between the insurance sector actors and their customers, thus contributing to the establishment of a relationship of trust between the two parties and, consequently, to the development of the insurance activity.

It not only makes it possible to detect possible breaches of the rules for the protection of policyholders enacted in the Insurance Code and regulations relating to consumer protection, but also to anticipate possible regulatory deficiencies in relation to the evolution of market practices in order to proactively review and adapt the regulations.

The Authority is also entrusted with the task of investigating and processing the policyholders' claims and working to resolve them. The policyholder can thus, in the event of a dispute with his insurer, contact the relevant services of the Authority to file a complaint. For this purpose, the Authority has ensured the effective implementation of a mechanism to improve the processing of insured individuals and contract beneficiaries' claims in a fast, transparent and efficient manner.

The control of insurance products is intended to ensure that the products offered to consumers are understandable, balanced, useful, and comply with the regulations in force.

Article 247 of the Insurance Code, which provides for the control of the conformity of specimens of insurance products, also aims to make insurance companies more accountable for the quality of insurance products through the implementation of an internal validation process by these companies of their products before they are issued on the market and communicated to the Authority.

The Authority's protection mission is reinforced by article 6 of the law No. 64-12 establishing the Authority which stipulates that ACAPS ensures compliance with the rules of good practices and protection of the insured and beneficiaries of contracts and works for the development of the insurance business.

Complaint

The Authority will study your complaint in its capacity as a supervision authority and, if necessary, will take the most adequate measure in accordance with the legal requirements and within the scope of ACAPS powers.
